Where Jackson County Family Law Cases Are Filed

Jefferson is the county seat of Jackson County. Divorce, custody, legitimation, and support cases for Jackson County residents are filed in the Superior Court of Jackson County, which is part of Georgia’s Piedmont Judicial Circuit. Since January 1, 2025, the Piedmont Circuit has covered just two counties: Jackson and Barrow.

The courthouse is at 5000 Jackson Parkway, Jefferson, GA 30549. The Clerk of Superior Court’s office is in Suite 150 of that building (phone 706-387-6255) and keeps the official file for your case. When we represent you, we prepare and file the pleadings and track every deadline.

Mediation Is Required in Piedmont Circuit Domestic Cases

The Piedmont Circuit has its own mediation rules. Contested domestic cases filed on or after September 1, 2025, including divorce, legitimation, alimony, and modifications of custody, visitation, or child support, must go to mediation or to a judicially hosted settlement conference before the case can be tried. Child support enforcement and contempt cases are exempt.

Every domestic case is screened for domestic violence before mediation is scheduled. Mediator fees are generally split between the parties. The circuit’s ADR program office is in the same courthouse on Jackson Parkway. We prepare you for the session, attend it with you, and make sure any agreement protects you before you sign. Our article on divorce mediation explains what a session looks like.

Family Law Matters We Handle

Communities We Serve in Jackson County

Besides Jefferson, Jackson County includes Commerce, Hoschton, Arcade, Nicholson, Pendergrass, Talmo, and parts of Braselton and Maysville. Family law cases for residents of any of these communities are generally filed in Jefferson. If you live in Commerce, see our Commerce family law page.

Parents and Custody

Divorcing parents in the Piedmont Circuit are expected to complete a seminar for divorcing parents, and every custody case needs a parenting plan covering living arrangements, holidays, and decision-making. Our Georgia parenting plan guide walks through what goes into one, and our child custody page explains how Georgia judges decide custody.

Jefferson Family Law FAQ

Is Jackson County in the same judicial circuit as Athens?

No. Athens-Clarke County is in the Western Judicial Circuit, while Jackson County is in the Piedmont Circuit, which has its own judges, standing orders, and mediation rules. We handle family law cases in both circuits and know the differences.

When does mediation happen in a Jackson County divorce?

Under the circuit’s ADR procedures, the parties confer about mediation dates after discovery closes, and the ADR rules set deadlines for holding the first session and completing mediation. We handle the scheduling and paperwork.

I was just served with divorce papers. What should I do first?

Note the date you were served, because you have a limited time to file an answer. Avoid moving money, property, or the children until you have legal advice. Our article on what to do when you’re served with divorce papers in Georgia explains the next steps.
