What Is an Uncontested Divorce?

A divorce is uncontested when both spouses agree on every issue before the case is filed. That includes dividing property and debts, alimony, and, if you have children, custody, the parenting schedule, and child support. If even one issue is still open, the case is contested until you resolve it.

Most uncontested divorces in Georgia are filed on no-fault grounds, meaning the marriage is “irretrievably broken.” Neither spouse has to prove the other did anything wrong.

Do You Qualify?

You are likely a good fit for an uncontested divorce if:

  • You or your spouse has lived in Georgia for at least six months before filing.
  • You both agree the marriage is over.
  • You agree on property, debts, and support.
  • If you have children, you agree on custody, a parenting schedule, and child support.
  • Your spouse is willing to sign the papers acknowledging the case.

If you agree on most things but not everything, we can often close the gap through negotiation or mediation and still keep the case out of a contested trial.

How the Process Works in Georgia

  1. Free consultation. We talk through your situation and confirm an uncontested divorce fits.
  2. Drafting. I prepare the complaint, settlement agreement, and, if you have children, the parenting plan and child support worksheet.
  3. Review and signing. You and your spouse review everything. Your spouse signs an acknowledgment of service, so no sheriff has to deliver papers.
  4. Filing. I file the case in the Superior Court of the right county, usually where your spouse lives.
  5. Waiting period. Georgia law does not allow a no-fault divorce to be granted until at least 31 days after your spouse is served.
  6. Final decree. The judge reviews the agreement and signs the final decree. In most Western Circuit cases, neither of you has to appear in court.

Local Courts I File In

Most of my uncontested cases are filed in Athens-Clarke and Oconee counties, which make up the Western Judicial Circuit. I also file in Madison, Oglethorpe, Jackson, Barrow, Walton, Morgan, Greene, Putnam, Wilkes, Elbert, Hart, and Franklin counties. Each court has its own filing preferences, and getting those details right keeps your case from sitting in a stack.

If you have children, the judge may require both parents to complete a short parenting seminar before the divorce is final. I’ll tell you which program your court accepts.

What Affects the Cost

An uncontested divorce costs far less than a contested one because there are no hearings, discovery, or trial. What you pay depends on:

  • Whether you have children, which adds a parenting plan and child support worksheet
  • How much property, retirement, or debt has to be divided
  • Whether the agreement is already worked out or still needs negotiation
  • The court’s filing fee, which the clerk sets

I’ll give you a clear fee at your consultation, before you commit to anything.

Why Hire a Lawyer for an Uncontested Divorce?

Online forms look simple, but small mistakes cause real problems. A vague property clause, a child support worksheet that doesn’t match the agreement, or a missing retirement division order can leave you back in court later. When you hire Samuel Thomas Law, you work directly with me from the first call to the final decree.

I can represent only one spouse. Your spouse is free to have the agreement reviewed by their own lawyer.

Uncontested Divorce FAQ

How long does an uncontested divorce take in Georgia?

A judge cannot grant a no-fault divorce until at least 31 days after your spouse is served. Many uncontested cases are final within one to two months of filing, depending on the court’s schedule.

Do we have to go to court?

Usually, no. Most judges in the Western Circuit (Athens-Clarke and Oconee) sign the final decree based on the paperwork. If your judge holds a short final hearing, I’ll prepare you for it.

Can we use one lawyer for both of us?

No. A lawyer can represent only one spouse. I can draft the agreement for my client, and your spouse is free to have their own lawyer review it.

What if we agree on almost everything?

Bring the open issues to your consultation. Many couples settle the last few points through negotiation or mediation and still finish without a contested trial.

How long do we have to live in Georgia to file?

You or your spouse must have lived in Georgia for at least six months before filing.
